By shopping with nude you are agreeing to the terms below which apply to any purchase made on our web site. These Terms and Conditions were most recently updated on June 6th 2007 and apply to sales to the general public. If you are a business, different terms and conditions will apply. If it appears to us that you are a business we will contact you to set up a business account and our business account terms and conditions will then apply.
This web site is operated by Nude Brands Limited ("we", "us" or "our"). All purchases made on this web site are governed by these Terms and Conditions at any time although the Terms and Conditions governing any given purchase will be those in effect at the date of your order. If you order goods after we have published any changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the precise terms and conditions applicable to your purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date and time when these Terms and Conditions were most recently updated.

Your obligations and responsibilities

When accessing or using our site, you are bound by these Terms and Conditions. You shall always act in accordance with the law, custom and in good faith. You may not make any change or alteration to the Site or any Content or services that may appear on this Site and may not impair in any way the integrity or operation of the Site. Without limiting the generality of any other provision of these Terms and Conditions, if you default negligently or wilfully in any of the obligations set forth in these Terms and Conditions (including our Privacy Policy), you shall be liable for all the losses and damages that this may cause to Nude Brands Ltd, our affiliates, partners or licensors.

When registering as a customer with nude you are confirming and guaranteeing that the personal information which you are required to provide when you register is true, accurate and current in all respects. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

If you forget your password we will reset it upon your request and send it to the email address, which you specified when you registered.

Indemnity

You agree to defend, indemnify and hold us harmless for any loss, damages or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand resulting from your use of the Site. You also agree to indemnify us for any loss, damages, or costs, including reasonable legal fees, resulting from any action you take that imposes an unreasonable burden or load on our infrastructure.

About the information we collect

Your privacy and the security of your personal information is our highest priority. The only personal information we collect is information that you give us when you register and when you place an order. We use that information to service your account and to personalise your experience at nudeskincare.com The personal information Nude will collect generally comprises name, address, contact details (address, email), credit card or bank details and skin type / condition. By providing such information to us, you will be deemed to have consented to our collection of such information. If you have provided us with the personal information of any third party, please ensure that you have their consent to do so.

Your name and address is required to send you catalogues, samples and to deliver your goods.
We ask for your e-mail address and password when you register on the site. You then do not need to re-enter your name and address when you return to the site at a later date. We use your email address to confirm your order and to keep you informed of its progress.

The only other occasion when Nude will use your e-mail address is, with your permission, to send you from time to time, further information on products and special offers. Again, you have to opt in to receive this information and any promotional email that you receive from us will also allow you to unsubscribe to further email promotions if you decide at a later stage that you no longer wish to receive emails with news and special offers from Nude. Security measures

We implement various security measures in accordance with industry standards to protect the security of your personal information. Your personal information will be stored at facilities located in the UK. Please note that our website has a switch-off timer of 30 min if it remains inactive for any period. If you share a computer, we recommend that you always sign out (by closing all browser windows) before leaving it unattended. Nude will have no liability for disclosure of information due to errors in transmission or unauthorised acts of third parties.

Disclosure

Your details will never be disclosed to any third party unless for compliance with any applicable law, regulation, legal process or governmental request. We will also release specific information in special cases, such as if there is an attempted breach of security or a physical threat to you or others.

By using nudeskincare.com and providing us with your personal information, you are accepting the privacy practices described in this policy statement. We may update our Privacy Policy from time to time. Please check back here occasionally. Updates to our Privacy Policy that would affect how we treat your personal information will not apply to information collected before we made the update, unless we first obtain your consent.

Purchase of products

Payment

Payment may be made by debit, credit or charge cards. The debit, credit and charge cards accepted by us are those listed on the web site on the date on which your order is placed. Authority for payment will be requested from your card issuer at the time of your order.

Credit Card Security. All credit card transactions are conducted on Barclaycard’s ePDQ secure server. No card details for website transactions are held on our own site or seen by anybody at Nude Skincare Limited.

You agree to compensate us in full against all reasonable costs expenses and outgoings incurred by us in obtaining payments from you in the event a failed payment occurs. This will include an administration charge of not less than £20. We may at any time after a failed payment has occurred ask a debt collection agency to collect payment from you.

 

 

 

Electronic contract creation and cancellation

We will retain the legal ownership of the goods until full payment has been made by you and such payment has been received by us. Legal ownership of the goods will immediately revert to us if we refund any such payment to you.
Order Cancellations: Occasionally, orders or parts of an order are cancelled or held by our system for various reasons. Some reasons are:

  • Item(s) not available.
  • Difficulty in processing payment information.
  • Cannot ship to address provided.
  • Duplicate order was placed.
  • Cancelled due to a customer request.

If your order is cancelled, you will receive an email to explain the reason for the cancellation. You original payment method will be refunded to the appropriate amount.
If you wish to change or cancel your order prior to despatch please go to “my orders” in the “my account” section of the website or call our Customer Services Team on 0870 034 2666 with your order number.
Please note as we generally despatch orders within 24 hours, it may not be possible to cancel prior to despatch. In this instance you would have to return your order once received in accordance with our Returns Policy.

Eligibility

To be eligible to purchase goods on this Site and to lawfully enter into and form contracts on this Site under English law you must: (a) register on the Site; and (b) be the holder of a valid debit/credit card.

Prices

The prices stated on the website will be inclusive of any VAT payable. Prices are either quoted in US Dollars for customers in the US and in Pounds Sterling for all other countries.

Delivery

When shopping with nude we try to despatch on the same day any order placed before 1pm to ensure a speedy delivery.  If for any reason there is a delay, we will advise you immediately by email. We are unable to accept liability for loss of orders once they have been passed on to any national postal service other than Royal Mail.

  • Standard delivery (2-3 days) for £3.50
  • Guaranteed next working day delivery for £10.00

Guaranteed next day means next working day e.g. orders placed on a Saturday will arrive the following Tuesday, orders placed on by 1pm Monday – Thursday will arrive the following day.

  • We offer free UK delivery for any order over £100.00

Overseas deliveries

  • Standard delivery (3-4 days and trackable) for £10

Gift Wrapping

We will happily gift wrap your order in one of our beautiful gift boxes with your personalised message for £7.50

Returns

We will willingly refund any online purchase within 21 days of receipt within reasonable use, please contact customer service at customerservice@nudeskincare.com  or on 0800 634 4366 and return to Nude skincare, 4 Golden Square, London, W1F 9HT, UK.

Please keep your proof of postage until your refund has been received.  If the products are being returned because they were incorrectly supplied then we will also refund the postage and packaging costs.

We will do our best to ensure that all information, descriptions, photographs and prices of products appearing on the Site are correct at the time when the relevant information was entered onto the system. Though we aim to keep the Site as up to date as possible, the information including product descriptions appearing on this Site may not always reflect the product exactly at the moment you place an order.
